References in these Terms and Conditions to "we", "us" and "NOOKI" are to NOOKI.
1. Online Shopping
We aim to show our products, colours, and details as accurately as possible, but we cannot guarantee that your screen displays them exactly. We do not warrant that the Site will always be available, uninterrupted, or error-free. The Site may link to third-party websites that we do not control and are not responsible for.
2. Order Process
Orders placed on business days (Monday–Friday, excluding holidays) are typically processed and shipped within 2 business days. Placing an order is an offer to buy; a contract is formed only when we confirm your order has shipped. We may decline or cancel an order for reasons including items being out of stock, errors in pricing or product details, or a payment that cannot be processed.
3. Tracking Your Order
Once your order ships, we will email you a tracking number. We are not responsible for tracking inaccuracies from the carrier, or for delays or non-delivery caused by an incorrect or incomplete shipping address. Please make sure your address is correct at checkout.
4. Order Cancellation
Need to cancel or change your order? Email us at Ivy@topikclothing.com within 24 hours of placing it and we'll do our best to catch it before it ships. Once an order has shipped, please use our returns process instead — we'll guide you through it.
5. Payment Methods
All prices are in Canadian dollars (CAD). We accept the payment methods shown at checkout. Applicable taxes (GST) are added at checkout based on your province. Payments are handled through a secure, encrypted checkout, and we never store your full card details.
6. Pricing Policy
While we work hard to keep prices accurate, errors can occur. If we find a pricing error on an item you have ordered, we will contact you before shipping to confirm whether you would like to proceed at the correct price. If we cannot reach you, we may cancel the order and issue a full refund.
7. Product Availability
All products are subject to availability. We may limit quantities, discontinue products, or update our range at any time, and we cannot guarantee that an item will be in stock or restocked.
8. Account
If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Please tell us right away if you suspect any unauthorized use.
9. Prohibited Content & Conduct
When you submit reviews, photos, or other content, you agree not to post anything unlawful, misleading, offensive, or infringing, and not to misuse the Site (for example through spam, malware, or attempts to gain unauthorized access). By submitting content, you grant us a non-exclusive, royalty-free licence to use it for marketing and promotional purposes; you may ask us to remove your content at any time.
10. Product Use & Pet Safety
Our beds, mattresses, steps, and accessories are designed for pet comfort and are not a substitute for veterinary care. Please choose the correct size for your pet, follow any care instructions, and supervise your pet when introducing a new product. We are not responsible for injury or damage resulting from misuse, incorrect sizing, or lack of supervision.
11. Liability & Indemnity
To the fullest extent permitted by law, NOOKI is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products, and our total liability will not exceed the amount you paid for the product in question. Nothing in these Terms excludes or limits rights you have under applicable Canadian consumer protection law. You agree to indemnify NOOKI against claims arising from your misuse of the Site or breach of these Terms.

13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any disputes will be subject to the courts of Alberta. This does not affect any mandatory consumer rights in your home province.
14. General
We may update these Terms at any time, and the current version will always be posted on this page. We are not liable for delays or failures caused by events beyond our reasonable control, such as carrier disruptions, severe weather, or supply issues. If any part of these Terms is found unenforceable, the rest remains in effect.
15. Entire Agreement
These Terms, together with our Shipping & Refund and Privacy policies, form the entire agreement between you and NOOKI regarding your use of the Site.
